DEFYNE PERFORMANCE — SHIPPING AND ELECTRONIC DELIVERY POLICY

SECTION 1 — SCOPE OF THIS POLICY
1.1 Digital Business. DEFYNE PERFORMANCE currently offers digital products, online coaching, consultations, and related online Services.
1.2 No Physical Shipping. We do not currently ship physical products. Therefore:
(a) no physical shipping carrier is used;
(b) no physical shipping charge applies;
(c) no physical delivery estimate applies; and
(d) a shipping address is not normally required for delivery.
A billing address may still be requested by a payment provider for verification, taxation, fraud prevention, or legal purposes.
1.3 Electronic Delivery. Digital products and Services are delivered through one or more of the following:
(a) email;
(b) a download link;
(c) a customer account;
(d) a booking or consultation platform;
(e) Trainerize or another coaching platform; or
(f) another electronic method disclosed before purchase.
SECTION 2 — DIGITAL PRODUCT DELIVERY
2.1 Payment Confirmation. Digital delivery normally begins after payment has been successfully authorized and the order has passed any required security or fraud review.
2.2 Delivery Method. Depending on the product, you may receive:
(a) an order-confirmation email;
(b) a separate email containing a download link;
(c) access through your customer account; or
(d) instructions for accessing the purchased content.
2.3 Delivery Time. Digital products are generally delivered shortly after payment confirmation. However, delivery may be delayed by:
(a) payment review;
(b) fraud-prevention screening;
(c) incorrect customer information;
(d) email-provider delays;
(e) platform or internet outages;
(f) security concerns; or
(g) circumstances beyond our reasonable control.
2.4 No Guaranteed Instant Delivery. Unless a product page expressly states otherwise, electronic delivery is not guaranteed to be instantaneous.
2.5 Customer Responsibility. You are responsible for providing an accurate and accessible email address at checkout.
SECTION 3 — DOWNLOAD LINKS AND FILE ACCESS
3.1 Personal Access. Download links and digital files are provided only to the purchaser for personal use, subject to our Terms of Service.
3.2 Secure Storage. After receiving a digital product, download and store it on a secure device that you control. Do not rely on a download link remaining active permanently.
3.3 Link Limits. A download link may:
(a) expire after a period of time;
(b) have a limited number of download attempts;
(c) require account verification; or
(d) be disabled where unauthorized sharing or misuse is reasonably suspected.
3.4 Unauthorized Sharing. You must not share, forward, publish, sell, upload, or distribute a download link or digital product to another person.
3.5 Replacement Access. If a legitimate customer loses access, we may verify the original purchase before resending a link or restoring access.
SECTION 4 — MISSING DELIVERY EMAILS
4.1 Initial Checks. If you do not receive your digital product or access instructions, first:
(a) allow a reasonable period for payment confirmation and delivery;
(b) check spam, junk, promotions, and filtered-email folders;
(c) search your inbox for DEFYNE PERFORMANCE;
(d) confirm that the email entered at checkout was correct; and
(e) check whether the order payment was successfully completed.
4.2 Contacting Us. If the delivery is still missing, contact defyneperformance@gmail.com and provide:
(a) your full name;
(b) the email address used at checkout;
(c) the order number, if available;
(d) the product purchased; and
(e) a description of the problem.
4.3 Verification. We may request reasonable information to confirm the purchase and protect the order from unauthorized access.
4.4 Resolution. After verification, we will make a reasonable effort to:
(a) correct the customer email address;
(b) resend the delivery email;
(c) issue a replacement download link;
(d) restore account access; or
(e) provide another reasonable electronic delivery method.
SECTION 5 — INCORRECT EMAIL ADDRESSES
5.1 Customer Error. DEFYNE PERFORMANCE is not responsible for an initial delivery failure caused by an incorrect or inaccessible email address supplied by the customer.
5.2 Corrections. If you entered an incorrect email address, contact us promptly. After verifying the order, we will make a reasonable effort to update the information and resend access.
5.3 Security. We may decline to change an order email address where:
(a) ownership cannot be reasonably verified;
(b) fraud or unauthorized access is suspected; or
(c) the requested change could expose another person’s information.
SECTION 6 — DAMAGED OR UNUSABLE DIGITAL FILES
6.1 Technical Problems. Contact us within 14 days after purchase if:
(a) a file is corrupted;
(b) a file is incomplete;
(c) the file will not open in the disclosed format;
(d) the wrong digital product was delivered; or
(e) a technical problem prevents reasonable access.
6.2 Supporting Information. We may request:
(a) the order number;
(b) the device or software being used;
(c) a screenshot of the error; or
(d) other information reasonably necessary to troubleshoot the issue.
6.3 Initial Remedy. We will first attempt to:
(a) resend the file;
(b) replace or repair the file;
(c) provide a new link;
(d) provide reasonable access instructions; or
(e) deliver the product through another suitable electronic method.
6.4 Failed Delivery. If we cannot provide a working copy of the purchased digital product, the remedy will be handled under our Return and Refund Policy and applicable law.
SECTION 7 — DEVICE AND SOFTWARE COMPATIBILITY
7.1 Requirements. You are responsible for maintaining:
(a) a compatible device;
(b) suitable software;
(c) a stable internet connection;
(d) sufficient storage capacity; and
(e) secure account credentials.
7.2 Disclosed Formats. Review the product description for any disclosed format, software, equipment, or access requirements before purchasing.
7.3 DEFYNE Responsibility. If a digital product does not match the format or requirements described before purchase, contact us so we can investigate and provide an appropriate remedy.
SECTION 8 — ONLINE COACHING DELIVERY
8.1 Service Delivery. Online coaching is a Service and is not physically shipped.
8.2 Coaching Platform. Coaching may be delivered through Trainerize or another disclosed platform and may include:
(a) programming;
(b) workouts;
(c) assessments;
(d) check-ins;
(e) coach messaging;
(f) progress tracking; and
(g) related materials.
8.3 Access Instructions. Access or onboarding instructions will generally be sent electronically after:
(a) successful enrolment;
(b) payment confirmation;
(c) completion of any required intake information; and
(d) any reasonable setup required for personalized coaching.
8.4 Personalized Setup. Personalized coaching may require preparation and is not guaranteed to be available immediately after payment.
8.5 Customer Requirements. You are responsible for:
(a) providing an accurate email address;
(b) completing required intake steps;
(c) accepting or creating applicable platform access;
(d) maintaining compatible technology; and
(e) protecting your coaching-account credentials.
8.6 Platform Delays. If a coaching platform is temporarily unavailable, we may use another reasonable communication or delivery method while the issue is addressed.
SECTION 9 — CONSULTATIONS AND BOOKINGS
9.1 Electronic Confirmation. Consultations and strategy calls are not physically shipped. Booking confirmations and access instructions are delivered electronically.
9.2 Customer Responsibility. You are responsible for:
(a) providing accurate contact information;
(b) reviewing the scheduled date, time, and time zone;
(c) maintaining a suitable internet connection where applicable; and
(d) joining through the provided link or method.
9.3 Missing Confirmation. Contact us if you do not receive a booking confirmation or access instructions within a reasonable period after booking.
9.4 Cancellations. Rescheduling, missed-session, and cancellation rules are governed by our Return and Refund Policy and any terms disclosed when booking.
SECTION 10 — FREE DIGITAL PRODUCTS
10.1 Electronic Delivery. Free guides, downloads, or other free digital materials may be delivered through email, a download page, or another electronic method.
10.2 Availability. Unless otherwise stated, we may modify, replace, limit, or discontinue a free product or its delivery method.
10.3 No Monetary Value. A free product has no refundable purchase value.
SECTION 11 — SERVICE INTERRUPTIONS AND DELAYS
11.1 Reasonable Delays. Electronic delivery may be affected by:
(a) scheduled maintenance;
(b) platform outages;
(c) email-provider interruptions;
(d) internet or power failures;
(e) cyberattacks or security incidents;
(f) payment-provider reviews; or
(g) events beyond our reasonable control.
11.2 Resolution. Where a delay occurs, we will make a reasonable effort to restore access or provide another delivery method.
11.3 Refund Rights. If we cannot provide a purchased product or materially deliver a purchased Service, any refund or credit will be determined under our Return and Refund Policy and applicable law.
SECTION 12 — PRIVACY AND SECURITY
12.1 Personal Information. Information used to deliver digital products or coaching is handled under our Privacy Policy.
12.2 Third-Party Platforms. Shopify, Trainerize, email providers, booking systems, and other delivery platforms may process personal information according to their own privacy policies.
12.3 Account Security. Do not share customer-account, download, booking, or coaching-platform credentials with another person.

SECTION 14 — POLICY CHANGES
14.1 Updates. We may update this policy to reflect changes to our products, delivery systems, platforms, or legal obligations.
14.2 Existing Purchases. A policy update will not retroactively remove a delivery or refund right that applied to an earlier purchase unless permitted by law.
14.3 Current Version. The “Last Updated” date identifies the current version of this policy.
